ERS Terms of Service

These Terms govern your use of ERS (Estimate Recovery System), a web application operated by PVO Labs LLC, a New Mexico limited liability company, 1209 Mountain Road PL NE, STE R, Albuquerque, NM 87110, United States ("PVO Labs", "we", "us"). They apply together with our general Terms of Service, Terms of Sale, Refund Policy and the ERS Privacy Notice. If these ERS Terms conflict with our general Terms, these ERS Terms apply to ERS.

1. What ERS does

ERS helps a business follow up on estimates it has already sent. You add an estimate (customer name, email, amount, date sent and optionally the estimate file). ERS then sends a short sequence of follow-up emails to your customer on your behalf, in your business name, with replies going to your own email address. Each email links to a page where your customer can accept the estimate, say they are still deciding, decline, or unsubscribe. ERS shows you where each estimate stands.

On the Estimates + Invoices plan, ERS also follows up on unpaid invoices you add to it (customer, amount, due date and optionally the invoice file): it sends polite payment reminders in your business name until you mark the invoice paid.

ERS does not create estimates or invoices, does not collect payments, does not send text messages and does not call anyone.

2. Accounts

ERS is available by invitation. We create your account after you purchase a plan, and send an invitation to the email you give us. You may invite team members to your account. You are responsible for everyone who uses your account and for keeping your login secure. Tell us right away at pierre@pvolabs.com if you think your account has been accessed without your permission.

3. Getting access

ERS no longer offers a free trial. You purchase a monthly plan on pvolabs.com and we set up your account within 1 business day. Trials started before November 7, 2026 keep their original terms: you are never charged automatically at the end of such a trial, and if you do not purchase a plan, follow-ups stop being sent at the end of the trial and your data is handled as described in section 11.

4. Plans and billing

ERS is offered as a monthly subscription at the price shown on pvolabs.com at the time of purchase (currently, for one business: USD 59 per month for the Estimates plan, or USD 79 per month for the Estimates + Invoices plan). Your subscription renews automatically each month until you cancel. Prices do not include taxes that may apply. We may change prices for future billing periods with at least 30 days' notice by email; the change applies from your next renewal after the notice period.

5. Cancellation and refunds

You can cancel at any time by emailing pierre@pvolabs.com before your next renewal date. Your account stays active until the end of the period already paid. If you request it within 14 days of your first paid charge, we refund that first charge in full. Other charges are not refunded for a partial month, except where our Refund Policy or the law requires it.

6. You are the sender

Follow-up emails are sent on your behalf and in your business name. You are responsible for them and for your relationship with your customers. In particular, you agree that:

• you only add people who asked you for an estimate or who are your existing customers, and you have the right to contact them about that estimate;
• the information you enter (names, emails, amounts, files, business details) is accurate and you have the right to share it with us;
• you enter a valid physical postal address for your business, which ERS adds to every email as US law requires;
• you do not use ERS to send unsolicited marketing, to contact people who asked you to stop, or to send anything unlawful, misleading, threatening or offensive;
• you comply with the laws that apply to your communications, including the CAN-SPAM Act and applicable state laws.

ERS adds an unsubscribe link to every follow-up email and stops emailing a customer who unsubscribes. Do not try to work around it.

7. Sending limits, bounces and complaints

To protect deliverability for all users, ERS limits the number of emails an account can send per day, sends only during business hours in your time zone, stops emailing addresses that bounce, and stops emailing customers who mark a message as spam. We may pause sending from an account that receives repeated spam complaints or bounces, or that we reasonably believe is misusing ERS, and we will tell you why.

8. Your data

The business information and customer information you add to ERS ("Customer Data") belongs to you. You give us permission to store and process it only to provide ERS to you, to secure it, to support you and as required by law. We do not sell Customer Data and do not use it to market to your customers. The ERS Privacy Notice explains how we handle it.

9. Acceptable use

You may not: share your account outside your business; resell or sublicense ERS; try to access another account's data; probe, overload or bypass the security of ERS; upload malware; or use ERS to send messages for anyone other than your own business.

10. Availability and changes

We work to keep ERS available and reliable, but we do not guarantee that it will be uninterrupted or error-free. ERS relies on third-party services (hosting, database and email delivery providers). We may improve or change features; if we remove a core feature you rely on, we will tell you in advance and you may cancel.

11. Export and deletion

You can export your estimates and related data from ERS at any time while your account is active. After you cancel (or when an earlier trial ends without a purchase), we keep your account data for 30 days so you can come back or export it, then we delete it, except where we must keep some records by law (such as billing records).

12. No guaranteed results

ERS is a tool that helps you follow up. We do not guarantee that any estimate will be accepted, or any amount of revenue.

13. Warranty and liability

We will make reasonable efforts to fix defects that prevent ERS from working as described. To the fullest extent permitted by law, ERS is otherwise provided "as is", and PVO Labs is not liable for indirect or consequential losses, such as lost profits, lost opportunities or lost data, or for the content of the emails you choose to send. Our total liability related to ERS is limited to the amount you paid for ERS in the 3 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

14. Suspension and termination

We may suspend or close an account that seriously or repeatedly breaches these Terms, after notice when reasonably possible. If we close your account without cause, we refund any prepaid amount for the period not used.

15. Changes to these Terms

We may update these Terms. The "Last updated" date shows the latest version. If a change materially affects you, we will tell you by email at least 15 days before it applies.

16. Governing law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-law rules, and without prejudice to any mandatory consumer protection laws of your state of residence. Before any legal action, please contact us so we can try to resolve the issue amicably.
